These terms are the agreement between you and Motify. By creating an account, or by using the trial without one, you accept them. They are written to be read, so where a clause could be said plainly it is.
The short version. Motify analyses chess games from accounts you have proven are yours and turns the tactics you missed into puzzles. Free costs nothing and is limited; Plus is a subscription you can cancel at any time and which then runs to the end of the period you paid for. Do not use the service to analyse other people's accounts, to cheat at chess, or to scrape the site. The service is provided as it is, and the privacy policy covers what happens to your data.
Motify is operated by an individual trading as Motify, based in Australia, at motifychess.com. "We" and "us" mean that operator. "You" means the person using the service. Contact is support@motifychess.com.
Motify reads the game history of a chess account you have connected, replays each game through a chess engine, and keeps the positions where a tactic was available and you played something else. Those positions become puzzles, each introduced by practice puzzles on the same idea drawn from lichess's public puzzle database.
It is a training tool. It is not a coach, it does not guarantee that your rating will improve, and the engine's judgement of a position, while good, is not infallible.
You must be at least 13 years old to create an account, or older where your country requires it. You are responsible for keeping your password to yourself and for what happens under your account. Give accurate information when you sign up; an account created with someone else's email address may be removed.
One person, one account. You may close your account at any time from the account page, which deletes it and your data immediately and permanently, as described in the privacy policy.
This is the clause that matters most, so it is the plainest.
You may only connect a chess account that is yours. Motify requires proof before it will read anything: on lichess by signing in through lichess, and on Chess.com by putting a one-time code on your public profile. Attempting to have another person's games analysed is a misuse of the service and grounds for closing your account.
Motify reads only what those platforms already publish. Your relationship with lichess and Chess.com is governed by their terms, not ours, and those platforms may change or withdraw access to their interfaces at any time. If that happens, the part of Motify that depends on it stops working, and that is outside our control.

Analysis is expensive to run. We may apply reasonable limits to how much work a single account can ask for, and may slow or suspend an account making demands out of proportion to ordinary use.
The free plan is genuinely free and needs no payment details. It is limited: five of your own tactics a day, the fifty most recent tactics kept, thirty days of history, one row of the openings table, and no per-motif breakdown. The current limits and prices are on the pricing page, which is the authoritative version if it ever disagrees with this paragraph.
There is also a trial that needs no account at all: type a chess username and Motify builds a short run from the first tactics it finds. Nothing is stored against you personally for it beyond what the privacy policy describes.
Plus is a recurring subscription, monthly or yearly, charged in advance through Stripe. Prices are shown on the pricing page before you pay, in the currency stated there, and include any tax we are required to charge. Your subscription renews automatically at the end of each period until you cancel. Card details are handled by Stripe and never reach our server.
You can cancel at any time from the account page, with no notice period and nothing to ask anyone for. Cancelling stops the next renewal; your Plus features run until the end of the period you have already paid for, and then the account returns to the free plan. Your data is not deleted when a subscription ends, though the free plan's limits apply again to what you can see.
We do not generally refund part-used periods, because you keep the service until the period ends. If something was charged in error, if the service was substantially unavailable for a meaningful part of what you paid for, or if you are simply unhappy and it has been a matter of days, write to support@motifychess.com and we will sort it out. Nothing here removes a refund right you have under consumer law, and in Australia the guarantees in the Australian Consumer Law apply regardless of what this paragraph says.
If the price of a subscription changes, existing subscribers will be emailed at least 30 days before it applies to them, and may cancel before it does. An introductory or launch price applies for the period stated when you took it.
The site, its design, its code and its written content are ours. You may not copy or redistribute them beyond what the law allows.
Your chess games and your record remain yours. We store and process them to provide the service and for nothing else. The practice puzzles come from lichess's puzzle database, which lichess publishes under the Creative Commons CC0 licence. Chess positions themselves are facts about a game and are not owned by anyone.
Motify runs on a single server and is maintained by one person. It will sometimes be down, for deployments, for maintenance, or because something broke. We aim to keep it available and make no promise of a particular level of uptime. Features may be added, changed or removed; where a change materially reduces what a paying subscriber gets, they will be told before it happens.
To the extent the law allows, the service is provided "as is" and "as available", without warranties of any kind, including that it will be uninterrupted, error-free, or that the analysis will be correct in every position.
To the extent the law allows, we are not liable for indirect or consequential loss, for lost data, or for loss of rating, opportunity or profit. Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the twelve months before the claim, or AUD 50.
None of this limits rights that cannot be limited. In Australia, our goods and services come with guarantees under the Australian Consumer Law that cannot be excluded, and in the UK and EU, consumer rights that cannot be contracted out of continue to apply in full.
You may stop using Motify at any time and delete your account from the account page. We may suspend or close an account that breaches these terms, in particular clause 4 or clause 5, and where the breach is not serious we will say what is wrong and give you a chance to put it right first. If we close a paid account for a reason that is not your fault, the unused part of the period is refunded.
If these terms change, the date at the top changes with them. For a change that materially affects your rights or what you pay, account holders will be emailed before it takes effect. Continuing to use the service after that is acceptance of the new version.
These terms are governed by the law of Australia, and the courts there have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer law of the country you live in, or of the right to bring proceedings there.
If any clause here is found unenforceable, the rest continues to apply.
